Sir Paul McCartney and Heather Mills are the latest celebrity couple to find out the hard way that divorce often ends in a long, acrimonious and expensive court battle. But many costly annulments could be avoided if alternative and less hostile means of separation were explored first, new research suggests. Sir Paul says his experience of seeking a divorce - which has included mediation - is like “going through hell”. In an interview with Radio Times, published today, the former Beatle, 65, adds: “As Winston Churchill once said, If you are going through hell, keep going! The only solution is to remain dignified. If I dont keep a silence about it, I lose this idea of being dignified.” The NAOs research implies that solicitors are costing the public purse up to 10m a year by putting profits before their clients interests. Under the legal aid system, solicitors can expect to be paid much more in fees if their case is settled in court. In a third of cases examined by the NAO, lawyers had failed even to suggest that a client seeking a divorce or separation should first consider mediation as alternative to court. The Legal Services Commission (LSC), which authorises legal aid payments, spends about 300m a year helping those who qualify for state funding to deal with a family breakdown.

I am talking about the chronic givers–elderly people and those who are doctor dependent. One woman has kept me in eight varieties of home made jam for years. To her I give excess produce from my garden (whether it is suitable for incorporation in jam or not). Everywhere the welcome was warm; sometimes there were drinks and mince pies, and we collected chocolates and bottles ourselves as the afternoon progressed. These patients had become special to my father over the years by virtue of their age, their disabilities, their social isolation, or just their personalities. Moreover, I suspect that giving as well as receiving at Christmas helped him to maintain a position of strength through the ensuing 12 months of regular visiting, a feature of general practice in those days.

Old habits may die hard, but apparently - at least when it comes to celebrating the holidays with co-workers - so do recently acquired ones. Thats what Linda Skole, president of Chez Josef in Agawam, has observed over the past six years. In 2001, the holiday party business took a major hit nationwide when, in the immediate aftermath of 9/11, no one felt much like partying. “Were expecting a very busy holiday season,” Skole told BusinessWest. “A few years back, after 9/11, some groups were holding back and doing fewer parties, but this year theyre coming back, and we have more private parties scheduled this year than weve seen in a while. I think people realize the positive influence these events have on company morale, that employees really do appreciate it.”
From this persons lofty yet obscured perch on the branches of his federal health-care plan, he has no idea what awaits him when he enters the real world of private health-care plans for seniors. As a former agent and purveyor of these programs, I could tell him he is woefully ignorant of the true costs and pitfalls faced now by seniors, let alone when he takes his future place among them. It is my sincere wish that someone, perhaps the author, will remind this fellow, at some point in the distant future, when half to 60 percent of his monthly income is devoted to drugs to keep him alive, that he should have saved more.

Yet others have expressed concerns about the programs complexities, and its potential for skyrocketing apparel prices and for opening the door to antitrust lawsuits. Martin Jischke, president of Purdue University, opted not to support the DSP despite student protests at his Indiana institution last spring. I am especially concerned about the requirement for unionization, Jischke wrote in a statement.

A PATENTLY PERFECT PROFESSION Still, another option intrigued her-a law career. “I decided I wanted an entire change,” says Feeman, now a patent lawyer for the Silicon Valley law firm Howrey Simon. At the time Feeman looked at the move not as the next step in her engineering career but as a clean break, she says. The search for a missing southern Utah man is getting a boost from a team of private investigators. The Private Investigator Association of Utah is volunteering some of its members time and skills to help track down Christopher Coan. Its a case that has perplexed police and left his family heartbroken. Coan, 18, vanished from a Subway shop in Iron County on Sept. 3, 2007. He left his drivers license, clothing and money behind. His 1994 maroon and silver Chevy S-10 Blazer with stickers on the back window hasnt been found. The temporary license tag expired in October, and the vehicle has been listed as missing in a national crime database.

The continuity of issues is interesting. Of greater interest, however, is what is not discussed in the contemporary literature in the area.. Few, if any, of the modern commentaries mention the impact of sport and recreation on the environment and the laws response to this impact. That is a significant omission because sporting and recreational activity is as much controlled by law as any other social behaviour. A simple example is the effect of a sports stadium which raises such issues as: the size and design of the stadium and its surrounding infra-structure; noise; traffic; drunken behaviour; crime; vendors; littering; advertising. This paper, then, will focus on the role of environmental protection laws and will use as a model the development of golf courses and golf estates as golf is seen as both a sport and a recreational activity. Golf courses, and especially golf resorts, are man-made re-arrangements of the natural environment. Therefore construction and maintenance of a golf course must conform to the range of modern laws which attempt to ensure that environmental issues are addressed from the outset and that the impact on the environment is monitored constantly. The challenge is to integrate environmental considerations into sustainable development. The argument will be that the environmental issues raised by sport and recreation are matters of global concern. While examples will be drawn from around the world most attention will be paid to the Republic of South Africa.

Edwards got the idea at a trade show where he saw pencils that had been made from recycled currency. He contacted J.R. Moon Pencil Co. in Lewisburg, Tenn., to discuss the feasibility of his idea, and then he set up a meeting between the pencil company and Lydall composite Materials Inc., a company that would convert the mail into the pencil materials. They did a test run to verify that the materials would be compatible and to identify what percent of mail the final composite would have. The test was a success with the pencil material ending up being about 25 percent recycled mail. The pencils will be used by postal employees in the performance of their jobs and will be distributed to students to increase awareness of recycling efforts. This product will not only provide the Postal Service with yet another method of recycling waste materials, it will also give us an opportunity to educate people about the environment, explained Charlie Bravo, manager, Environmental Management Policy, Washington, D.C. The Postal Service has long been involved in preserving and protecting the environment and has won many national environmental awards, including 20 Closing the Circle Awards from the White House.

The government is beginning a $30 million study to determine once and for all whether chelation therapy offers any benefit for sufferers of heart disease. Chelation therapy is the main treatment for lead poisoning. A manmade amino acid called EDTA is seeped into patients blood, through a vein, to sop up the toxic metal so it can be excreted in urine. Some doctors have argued for decades that chelation therapy also could clear blocked heart arteries, perhaps by sopping up inflammation-causing molecules or calcium in buildups that clog blood vessels. Federal regulators have cracked down on proponents for falsely promoting chelation as a proven heart remedy — several years ago the Federal Trade Commission forced a doctors group to quit such advertising — and warned that the therapy can cause kidney damage or other side effects, especially if not administered by a properly trained professional.
Chelating therapies are not new, and acceptance varies from country to country. In my humble opinion, there are reasons for this discrepancy in acceptance: 1. If you speak Latin to the Chinese, expect miscommunication. 2. To receive medical acceptance, you must prove the therapys effectiveness.

THE CYCLING COLUMN After paying a visit to Europes only cycling ergonomics centre, Cyclefit, at the end of November, I found myself referred on to a specialist sports physiotherapy clinic, Balance in south London, due to some niggles I was suffering from in my left knee. My hour at Balance last week was in many ways similar to my morning at Cyclefit, as I found myself being filmed on my bike and on the treadmill. But this time, the focus was more on the movement of my knees and pelvis, and whether I was keeping these in straight lines, as I should be.
Quite simply, I wouldnt be able to walk again without the help of my physiotherapist, says Debs Paterson, 26, who almost lost mobility after an horrific car crash in November 2003. A year and a half later, after months of intensive physiotherapy, she can now walk without aid. Her physical recovery was down to a strategy especially tailored for her needs, taking into account the severe trauma that the rest of her body had suffered as well. MY FRIEND Ian Sturrock once went to a fancy-dress party as the Menai Straits. He wore a sack, to which he attached rusty tins, seaweed, shells, bits of driftwood, used condoms and dead crabs. To complete the tableau, he put a kipper under each arm. He didnt win a prize or even get many dances. But he said that everyone looked at him. He was well pleased. But even Ian would have been staggered at the total looniness of the Australian Neil Wilson, the man who wanted to be a fish. Wilson has just been found dead at Toolondo, near Victoria. Strangely, he did not drown, but suffocated in the fish-shaped bodysuit he had made from heavy green plastic sheeting. Unfortunately, he had clearly not read as far as chapter three in How To Be A Fish, because in the costume he had forgotten to put in ventilation slits. He was discovered by a passer-by in a field close to Wilsons favourite reservoir, “where he was a familiar sight at the waters edge, swinging from a rope while pretending to be a fish”, my cutting says. Im afraid I cant tell you any more. Thats a shame, because this intriguing tale clearly raises more questions than it answers.
The judge said of Fontana - real name Glyn Ellis - “I hope they give him a prison uniform at Nottingham Prison to keep him warm.” The case was adjourned until July.

PHAROS INTERNET ACCESS CONTROL This past August, the Librarys Board of Trustees authorized the use of Pharos, new software that will not only set automatic time limits on Internet use but also allow patrons to select Internet filtering options for themselves and their children. Pharos has been custom designed for Fort Vancouver Regional Library and is believed to be the first of its kind. The password will only be used at the time of registration or to modify the registration form. To use the Internet, all that is needed is your library barcode and PIN number. When you “log on” to the Internet computer, the appropriate filtered or unfiltered version will appear on the screen (or access will be denied if the selected option was “no Internet access”).
Heres how it works. The systems computer at the Library Center is networked to a control panel at the Library Station, which stores a list of employees and their marching identification numbers. Staff members are issued an ID badge with their picture and name. These are not swipe cards and there is no magnetic strip. The badges contain an antenna no wider than a paper clip and only two centimeters long. When staff members hold their ID within three inches of the proximity sensor (little black box), it beeps and the door unlocks. The doors lock automatically as they close behind you. From the opposite side, either a motion detector senses your approach and unlocks the door, or a button next to the door unlocks it.If someones badge is lost or stolen, the number is deleted from the system and a new one is assigned. If this should occur, notify computer services staff as quickly as possible. The badges are attached to a small recoil unit that can be worn around the neck using a lanyard, attached to a shirt or worn on a wrist attachment. The recoil allows the card to be pulled out a couple of feet (and helps us not to look silly) when flashing it at the proximity sensor. IN THE Pacific last Sunday morning, just before Greenpeace entered the exclusion zone around Frances nuclear test site at Mururoa atoll, a small inflatable dinghy took to the water and slipped silently away. At the helm was the little-known man who has steered Greenpeace to its present position as the worlds most famous environmental group. Four inflatables had been launched from the flagship; three were intercepted and confiscated and the crew of the fourth were arrested after they had managed to get on to the atoll and scale the rig used to drill the holes for the atomic explosions which France now plans to restart after a three- year lull. But it is what Greenpeace refers to only as “the fifth inflatable” that threatens the real trouble. As the rest of the fleet turned away from the atoll, it kept going. There were three people on board: Chris Robinson, Henk Haazen - both veterans of the Auckland blast - and a man going by the name of David Fraser who is in fact David McTaggart, the honorary chairman of Greenpeace.
Holidaymakers using an inflatable dinghy rescued a man who was seriously injured after “tombstoning” more than 100ft into the sea from one of Britains most famous coastal landmarks. Hundreds watched from the beach near Lulworth Cove in Dorset as the 26-year old man floundered in the water after leaping from the top of Durdle Door, a natural limestone arch that juts 400ft into the sea. Kevin Burt, station officer of the Lulworth Coastguard Rescue Team, said the man, who has not been named, was lucky to have survived the drop on Saturday. Although the tide was on its way in, the seabed around Durdle Door was uneven, with many shallows and rocks.

INTRODUCTION Dean Monroe Freedman famously presents this problem in terms of the “perjury trilemma.”4 Dean Freedman notes that lawyers face three obligations in performance. The first two stem from the important, almost sacred, attorneyclient relationship. First, there is the duty to investigate a clients case. As Dean Freedman argues, “in order to give clients the effective assistance of counsel to which they are entitled, lawyers are required to seek out all relevant facts.”5 Second, there is the obligation of zealous client advocacy.6 These are potentially at odds with the third duty, the obligation of lawyers to the court. Lawyers are officers of the court and hold certain responsibilities as such.7 They have specific requirements imposed upon them in such a capacity that cannot be forsaken.8 disclosure of potential client perjury threatens the relationship between an individual accused of a crime and their one and only representative in the criminal justice system. “[T]o convert the defendants only champion into yet another member of the states legions seems an unnecessary and offensive step.”9 Dean Freedman argues that only two of these three obligations can be met at any given time.10 So which of the three should go? In our adversarial system, the relationship between a criminal defense attorney and her client is special. The first and second obligations are essential for zealous advocacy. 11 The third, however, is essential for lawyers as participants in the judicial system as a whole.12 This creates a complicated and difficult situation for a criminal defendant attorney.
